I agree with your points and as a person who would tend to the consequentialist side of an argument find your view is the one which will reduce the suffering of the every day people of Darfur. I can see the deontological reasoning of both Michelle and Nicholas Khristov but the consequences have only been thought out at an academic and distant (American) standpoint. Obviously in an ideal world all human rights abusers would face the ICC but it isn't such a simple process. The idea of bombing one of their planes just shows the mentality which led America to Iraq. There are two problems here, first the suffering and loss of life of the people. Second the Legal process of ICC to prosecute Bashir. The second is not the solution to the first.
