Get FISA Right, repeal the PATRIOT Act, and restore our civil liberties

FISA and the PATRIOT Act strike at the core of our Fourth and First Amendment Rights and institutionalize a surveillance society -- and  FISA's telecom immunity clause mocks the rule of law by not holding telecom companies accountable for any illegal actions.  Beginning the new Administration and Congress by focusing on these issues sends one of the clearest signals possible that that the new government is committed to ending the abuses of the last eight years and restoring our civil liberties.

In the first 100 days of the Administration, we ask that President Obama

- stay immunity lawsuits until after the Inspectors' General report in July (EFF's What Obama Can and Should do to Stop Telecom Immunity discusses this)

- comply with FISA and other legislation (including the warrant requirements) and clarify that he will not assert "Article II" power

- defer bulk surveillance of Americans, even though it has been authorized by the FISA Amendment Act

We also ask the new Administraiton and Congress to revisit last summer's flawed FAA during the debate about whether to renew sections 206 and 215 of the PATRIOT Act -- and to sunset these clauses as well as repeal the PATRIOT Act as a whole.

    Trust runs both ways. If our new leaders want the voters to have respect for and trust in their leadership, two things are necessary: transparency in their actions, and protection of our rights (which amounts to trust in and respect for the voter). We must know what our government is doing and what it has done. Our Constitutional rights MUST be protected, and those in a position of power must be held accountable, or "consent of the governed" is not possible. It is my belief that our Constitutional rights have been egregiously eroded by the Bush Administration. I also believe that essential governmental actions and processes have been hidden from the governed. If we are to move forward together quickly and with the required trust and respect to address the many serious problems facing America today, action to rectify the wrongs committed by the Bush Administration and by others at the behest of the Bush Administration must be addressed as soon as is reasonably possible.

    I sincerely hope that all your campaign promises are not forgotten when you are sworn into Office.
    Sworn in on the Holy Word of God, to Uphold and Defend The Constitution from All Enemies Foreign and Domestic.
    It seems that the Domestic Enemies are very prevalent in Washington D.C.
    Your predcessor did not live up to his oath.
    I'm not sure he even took it very seriously.
    GW and his cronies have tried to make Our Constitutional Republic into a Fascist Dictatorship.
    That being said, you know what "change" we really need.
    Correcting FISA, Repealing the Patriot Act is a great place to start.

    I was raised to be proud of my county and feel safe in the belief that my civil liberties would be protected by our Constitution and Bill of Rights.

    As George Carlin once quipped "It isn't a right if it can be taken away. We only have a Bill of Priviledges."

    I agree. With the Patriot Act and such Acts like H.R. 1955 are Un American. They are not created to protect the people our government should serve. They have been created to protect the Government which has not truly served it's people in over 100 years.

    By the people for the people? I am sure the "people" did not choose gas prices to soar and to be enguaged in wars that we cannot win. Like the War on Drugs?

    I am also sure the American people would also not like to live in gutters, on park benches and be starving in some areas.  And also, I am sure there are children right now living in poverty that makes those card board boxes in the alleys look like mansions. Starving children.

    Please help the American People! Instead of throwing money at these problems, assemble the best minds of our time and find solutions that everyone can help with. Even those of us living Hand-to-mouth!

    Not only should the Patriot Act be repealed for its unconstituionalty, but on the day (Oct 2nd, 2001) bill H.R. 2977 was passed, buried within a Space Exploration Initiative.  Excerpt follows:

    "(II) through the use of land-based, sea-based, or space-based systems using radiation, electromagnetic, psychotronic, sonic, laser, or other energies directed at individual persons or targeted populations for the purpose of information war, mood management, or mind control of such persons or populations; or (III) by expelling chemical or biological agents in the vicinity of a person."

    The goal of reducing poverty is admirable and should be supported by the U.S., but focusing on arbitrary development indicators like the Millennium Development Goals and aid targets that are only indirectly related to reducing poverty does little to advance that objective. The U.S. should maintain the independence of its foreign assistance programs, including its poverty alleviation efforts, by rejecting the policy recommendations of the Global Poverty Act and subjecting our Country to dictates and demands mandated by the United Nations; whom have demonstrated repeatedly are not kindly towards the U.S. 

    These policies are not really looking like "Change" we can beleive in, but rather, CHAINS we can beleive in.

    Uphold and defend the Constitution from enemies domestic as well as foreign - that's what the President of the United States must pledge to do.  Without working with Congress to fully repeal the FISA Amendments Act, Patriot Act and Military Commissions Act, Barack Obama's Oath of Office will be a farce.  This issue is the central test of whether Obama's promise of change was anything more than a campaign slogan.

President Bush had called for Americans to continue on with our lives, basically not to give in to the terrorists by changing the ways we did things because if we did then they would be winning. Then he goes and supports something like the 'Patriot Act', the most unamerican and unpatriotic thing he could have done. Please bring back the American way Mr Obama!

    Please honor the constitution by repealing the Patriot Act. It is a grossly flawed piece of legislation and needs to be burned. A freshmen in college could produce a better act for our country than that document that undermines and rapes the rights from the American people and others that come into contact with our country. How many people have been saved by it? I have not seen one news report or article that shows how effective it has been in protecting our country. It is time for an educated reappraisal of things coupled by scientific conjecture. I hope that our laws are not further based on dogmas and speculative fears. May reason prevail and ignorance sink into oblivion.

    You are absolutely correct. Our drug laws have destabilized (and done tremendous environmental damage in) Columbia, they continue to fund the Taliban In Afghanistan, they have caused thousands of deaths just this year in Mexico... but look at the many thousands of Americans who have built their lives around the "War on Drugs". That's a tough nut to crack.

    There is no greater misdeed than the patriot act. Anyone with common sense would never have approved of it in the first place. In the end, President Obama, it will come down to whether or not you are just another POLITICIAN. I've already witnessed enough of your false promises, to even begin to hope that you can or would do the right thing, you have too many friends in D.C. to please and pander to.
    If Obama's dismissive response to 75% of American that want Cannabis reform is any indicator, then we are all in for a terrible let down when we see Barrack in the true light of Politics, which is not and never will be Democracy. Capitalism undermines the true beauty and intent of democracy. Capitalism, Greed and Political Correctness (Whatever the hell that is), will continue to run this country, not Americans.
    How do we know this website is really for change? He has already dismissed cannabis reform and completely censored a highly voted for idea on reinvestigating 9/11. More than likely, this website is just to track down the last of us that dissent and black bag us.     The Get FISA Right, repeal the PATRIOT Act, and restore our civil liberties idea above sums up fundamental, "core" issues. The Constitution and Bill of Rights define our system of government as well as our national character.

    Unfortunately, both political parties in the US relegate civil liberties' issues to obscurity during and after elections. A large number of us (including myself), whether private citizens, independents, or party activists tend to tacitly condone this process. Other concerns often distract us.

    Now is the time to change this trend. We need to educate ourselves and our neighbors and let the in-coming president and Congress know that concern for, and outrage over the loss of, our fundamental freedoms does not push us to the fringes.

    I want to encourage people, especially activists, to address these issues rationally, yet make it clear that we at least want them on the agenda for serious consideration and hopefully concrete action. That is why I am committed to promoting this idea, this movement.

    That is also why I would ask like-minded folks to pull out all the stops and to keep finding new and creative ways to present these issues to those who remain unconvinced. We must show them that while erosion of civil liberties might not appear to affect them directly, it does if you look deep and consider the possibilities.
