Appoint a Special Prosecutor for the Crimes of the Bush Administration

President-elect Obama recently said, "if I found out that there were high officials who knowingly, consciously broke existing laws, engaged in coverups of those crimes with knowledge forefront, then I think a basic principle of our Constitution is nobody above the law." 

Attorney General-designate Eric Holder recently said top Bush Administration officials "authorized the use of torture, approved of secret electronic surveillance of American citizens, secretly detained American citizens without due process of law, denied the Writ of Habeus Corpus to hundreds of accused enemy combatants, and authorized the use of procedures that both violate international law and the United States Constitution."

The Bush administration has refused to investigate its own crimes and President Bush may issue blanket pardons before he leaves. President Obama must appoint a Special Prosecutor - ideally Patrick Fitzgerald - to fully investigate these crimes and prosecute those responsible to demonstrate that we are truly a Nation of Laws and no one - including the President - is above the law.

    The crimes that the Bush Administration has committed must not be allowed to go unpunished. The crimes are so huge I cannot understand why Congress did not act years ago. I was very pleased with Obama's election, but I am so discouraged that the new Administration appears to also ignore the lack of moral compass of this once-great country.

    Dear Honorable members of the Obama administration,

         It is now public knowledge that Bush and his administration have committed some of the worst crimes in American history. We know that they have tortured, conducted warrantless wiretaps of American citizens, and illegally detained individuals without trial for years resulting in many deaths. There is also significant evidence to indicate that Bush was receiving information that Iraq wasn't anywhere near the threat to America that he was stating publicly, but he never availed the American citizenry of that information. In light of the knowledge of these crimes, how can we not investigate and prosecute these criminals? Regardless of whatever else the Obama administration is able to accomplish, I will consider it a gross failure if it does not seriously consider accountability of these crimes as one of it's highest priorities. I beg you to consider how many millions of people around the world have had lives destroyed due to the Bush administration's actions and to consider how far we've strayed from our highest ideals. I thank you deeply for your service to our great nation.

     You cannot have two sets of Rules of Laws, one broken with no accountability, de facfto police powers in place, and another that ignores it by setting up a dual relationship with it.

    Failure to enforce the Rule of Law should itself be seen as impeachable which would includ a whole lot of complicit, criminal democrats who went along with Bush's corporate fascism.

    Obama either puts these people on trial and raise the question of democratic complicity, and the failure of three branches of government to confront illegal laws via their corporate imperial appeasement. 

    Prosecute the main War criminals and go after any complicit democrats, obstructionists, and kick them out for failing to uphold the Constitution, beginning with PELOSI, HARMAN, RHAM EMANUEL, BIDEN, CLINTON, all war hawks in OBAMA'S war cabinet.  Is he going to follow the RULE OF LAW by firing his NEOCONS, ZIONISTS, LIBERAL WARHAWKS who have signed on to illegal aggression against IRAN, and who are pushing for the same fascist illegal foreign policies.

    Holding Bush and his people accountable is not about looking backwards. It's all about deterring future presidents from abusing their powers. There's no guarantee that we won't have another president like Bush or worse down the road. We can't rely on "the system" to correct mistakes. The system is dead if we don't use it.

    Patrick Fitzgerald is a poor choice for Special Prosecutor.

    Any ambitious present member of the poisoned Justice Department is suspect.  A Special Prosecutor should be appointed from academia.  Law Professors of major law schools should select the Special Prosecutor who will need subpoena power (issued by Congress) and a cadre of investigators drawn from outside of Federal Government.  A "Truth and Justice" tribunal should then be empowered to bring these criminals to justice.

    You only find things out by conducting investigations. Will he investigate officials who may have knowingly broke the law, or will he look the other way, as he and most members of Congress have been doing all along.

    This not a 'gray area' of Law, when so many 'highly probable' to admitted acts of ciminal acts (wiretapping,Guantanamo,Abu Ghraib...this list is LONG) ARE DISREGARDED then the rule of Law is gone because it shows the two systems of Justice (?)-or rather 'lack of' and all this can be safely alleged PRIOR to ANY investgation...the World watches, dont sanction this assault on Law...be forward looking--show that YES WE CAN SHOW that we are a nation of laws NOT MEN,  and APPOINT A SPECIAL PROSECUTOR.     I will add my voice demanding that the top officials of the Bush administration be held accountable for the numerous impeachable, imprisonable offenses they have committed, some even publicly admitted to by none other than the criminal in chief.  Unfortunately, what we've already seen of Obama's actions - reversing his position on telecom immunity to support an anti-constitutional FISA bill, reneging on his promises to repeal the Bush tax cuts for the super rich and institute a windfall profits tax on the oil companies, and appointing hawks and many responsible for the current economic meltdown to his administration, I'm pretty confident that in the name of "bipartisanship" (i.e. cowardice), this new administration will betray its own promises and let these criminals off the hook.  I'm so tired of being betrayed and watching corporate interests rape this country and the world.

    I know you are a smart man, a compassionate man, a wise man, and a man who will lead by example.  Unfortunately, the present President and his administration are none of those things.  I am a decorated Gulf War veteran and served my country with honor for six years.  I am outraged at what the current adminstration has done to our country, our citizens and the people in Iraq and Afghanistan.  I lived through the Nixon era and survived, however, I truly believe Ford should not have pardoned Nixon for his crimes.  Nixon was a crook and he should have gone to prison.  Bush and his administration have ruled, raped and pillaged America long enough.  Make sure they pay for their crimes.

      How can it be constitutional to pardon yourself and all of your staff essentially saying yes, the executive branch IS above the law and is therefore functionally a DICTATOR-ship.

      Spying on Americans, Tony Blair, the President of Iraq, outing CIA agents, Torture, just a few of the High crimes outside his pillaging of our wild horses, wolves, environment and economy.

      How about all the other war crimes and lies to the UN? How many dear and innocent Iraqis are just plain DEAD? Like 200K!?

      We just cannot let all this and much more go! We cannot just turn the other cheek, but we can decide against the Death penalty Mr. Bush has so often used as Governor and President. Let's show our compassion by not using the death penalty, not using torture per say. Lets just allow Bush and Cheney to do community service 7 X 24 in a factory farm cleaning cages. Cheney in a Pig farm and Bush in a chicken farm. Then lets only give them pig and chicken to eat until all factory farms are done with. Yes, they should also live with these poor creatures as well.

    While we're at it, we must have a Congressional Investigation on the BLM for their handling of the Wild Horses in Burros as well as the GAO report which is an embarrassment to the GAO itself. Our entire government has stooped to the gutters in the last 8 yrs.

    Not convicting George W. Bush and Dick Cheney for every single published law broken is not acceptable. The lists of the crimes are everywhere. Start with Elizabeth de la Vega's "US v. Bush". Then check Vince Bugliosi's book. This 'starting over' will never be 'kosher' until the record is set straight. Not trying and convicting them and SENTENCING them will set a precedent that will be the ruination of our country, despite Obama's present tense win. It's not over just because of this. It's only just begun. There are many of them, and they are rich, and they have theological agenda's and they're not going to just go away.

    How is it possible that in this time of incredible knowledge and consciousness that the so-called TOP country in the world is so benighted?  It is time to clean up the stinking mess that two egomaniacal men and their greedy violent henchmen have made of the USA.   Bush is just a sad incompetent fool of a man with a weak character and serious religious delusions.  Cheney is a very dangerous cynical person who needs to be stopped in his tracks.  He is at this moment jetting around the world still making trouble and salting away his ill-gotten riches. Both need to be indicted quickly.   They call themselves patriots and persuade others to give up their very lives and their children for their own personal agendas!  But what do these so-called patriots actually do?  They strip their fellow citizens of their freedom and they rob them blind (about three trillion dollars have been stolen from us now).  And then they take the riches out of this country and invest them with our enemies.  How could such people have ever been elected?  Answer: because 50% of the people in this country have no idea what is actually going on in this universe.   They are NOT concerned with their country, let alone their planet,  they are concerned with THEMSELVES  alone.  Egotism, greed, fear and violence define them clearly.  We are NOT top country - we are hypocritical incompetents.    If we are ever to be taken seriously again we have to say goodbye to our anachronistic ridiculous agrarian 18th Century ways and enter the new age of awareness.   We are in the age of information - who cares about the input of creationist bumpkins who live in the dark ages.  Time to move on.  We need proportional representation which denies ignorant yokels the ability to derail any sensible policies that might ever see the light of day.  Get rid of the electoral college now! There must also be an end to the ridiculous manner in which bills are presented to congress.  Bills should one-pointedly deal with the intended focused objectives and cannot be adulterated with extraneous tacked on nonsense.  No tacking on of unrelated matters - ever.   One issue at a time.  Otherwise we get no progress.  Time to wake up and get efficient!   Our entire way of seeing has to change.  Europe has already gone through a lot of the recalibration that accompanies a paradigm shift.  We have not.  50% of Americans are irrational and tribal in mentality and have no wider awareness of the complexities of their universe.  They have to be educated.   Fast.   And what about the current congress?  Are they innocent?  No, of course not, they are almost all enablers of Bush and Cheney and completely complicit in this tragic farce of government.  We need NEW enlightened people in charge - not the same old gang of failed weaklings who cannot stand up for their beloved constitutional rights.    People (on average) always get the government they deserve and America deserved Bush and Cheney.   We had better change things and fast.  And that means we have to proscute every single unlawfu lact that we find starting with those of George Bush and Richard Cheney.   If we let these people walk free we are not serious about our humanity.  Impeach them both now and prosecute them.   Radical means one who gets to the root of the problem.  Liberal means one who thinks FREELY.  What the hell is wrong with that?   I thought America was interested in, even had a copyright out, on Freedom?   Liberals breath freedom.  We need to be liberal radicals.  I am proud to be a liberal progressive scientific evolutionary agnostic radical.  I reject attempts to stigmatize perfectly excellent words like these.

    George Bush and his henchmen made me ashamed to be an American. Torture? TORTURE????? Yes. That's right. Bush personally authorized torture. He is also personally responsible for the death and maiming of thousands of Americans and countless hundreds of thousands of Iraqi innocent civilians.

    He authoried illegal wire taps and admitted it in public.

    That alone should result in criminal prosecution.

    My message to President Obama is that he must not be like Gerald Ford and pardon his predecessor. Bush, Cheney, Rice, Gonzales, Myers, Rumsfeld, and on and on MUST be prosecuted criminally to the fullest extent of the law. And if we can't do it, I sincerely hope that they will all be arrested and fragged to The Hague to be prosecuted for war crimes.

    The fact that the Democratic leadership chose not to impeach the criminals in the White House says that they (mainly Pelosi) knows she was complicit by not coming forward to denounce torture when she saw it early on. President Elect Obama has a ridiculous number of emergency issues on his plate, but that is no reason to let Bush/Cheney/Rumsfeld/Gonzales and others roam free.  Without a Constitution and the rule of law, our country will not survive.  Instead of a special prosecutor, an independent Commission should be appointed.  Then Obama can turn his attention to the emergencies.  Please don't "make nice" to the Republican Party by adding the Democratic Party's crime of ignoring war crimes.

    Failure to try those in this administration guilty of War Crimes will destroy justification for rule of law anywhere, and forever on this planet.
    Presidential pardon powers were never intended to be used to cover up criminal acts, or to justify violations of law by our government. but rather to correct injustices in an imperfect system. They knew they were violating International Law and committing war crimes.
    If Congress fails us now, they are then co-conspirators and just as guilty as the rest are.

    The Bush administration's blatant flouting of both domestic and international law has brought the executive branch into disrepute and diminished the force of the US constitution. Some of President George W Bush'd actions are war crimes.

    If President Obama is serious about respecting the law these crimes must be investigated and brought out into the light of day even if President Bush pardons himself before leaving office, as seems increasingly likely.

    Abuse of power must not be tolerated. It threatens democracy.

    Not yet even though they should be dealt with severely.   First, we must fix what they took eight years to break. Putting Bush and Cheney in jail won’t create jobs and jump start a floundering economy.  

    As President Obama tackles these arduous tasks, I’m sure we’ll uncover more crimes.   I will gladly support legislation to eventually hold Bush and Cheney accountable as well as legislation to stop them from taking advantage of granting future pardons to themselves and others involved in covering up their lies.

    However, the first 100 days of the Obama Presidency will be hard enough and will call for tremendous bi-partisan support on the hill and from all citizens.

    The statute of limitations will not expire prematurely if President Obama is allowed to "fix" the major problems facing this country BEFORE he calls for the appointment of a Special Prosecutor.

    We are merely throwing gasoline on a fire that could destroy this country if impeachment and prosecution of Cheney and Bush were made a priority during these distressed financial times. I rank the impeachment of those two crooks and liars as important but timing is EVERYTHING. 

    As it stands now, I would NOT support this issue as the most urgent problem facing this country EVEN THOUGH the arrogance, secrecy and cronyism these two rapists and pillagers forced on America was as heinous as anything done by an administration in our history.

    As soon as the problems our nation faces are addressed and solved to some extent, there will be time for going after those who put us in this shape to begin with.  We still need the support of Republicans who are fair-minded enough to support President Obama’s goals.

    Stay diligent and ready to push the criminal case but to attempt this action at this critical time would be reckless in my opinion.

    Indeed a special prosecutor is needed. I'm disappointed nothing has been done up til now and I'm afraid nothing will be done at all as to not create a further riff w/ the GOP, but this is the most horrible reason to not up hold the law. Crimes were committed much more heinous than what  previous presidents have paid for .Hundreds of thousands of people have died because of the their actions committed on false pretenses.Torchure, spying on our own,  the list is so long, how can this go with out investigation? To allow this bunch to exit office without any hint of paying for there crimes is in itself a crime.I can hear Chaney now " It will never happen . I told you nobody will have the nerve to attempt an investigation let alone follow it through with a prosecution.Even Sen Obama cannot approve this , as he knows that he will never get one ounce of cooperation for anything from the GOP for life, if he attempts this. I told you in the beginning this would not be a problem. And look we still have the pardon card to play, so don't worry , they don't have the spine for this" 
        President Elect Obama, prove him wrong. Show us and the world there is a rule of law here, not just sweep it all under the rug and attempt to get this wrecked train of a country back on track. This requires a strong leader to go down this path, prove you are that leader. I believe you are.

    If 1) fraud on the United States, Congress and the American people as a subterfuge for a war for profit in Iraq, 2) the waste of military and monetary resources on this fraudulent war in Iraq, 3) obstruction of justice, 4) election fraud, 5) illegal spying on U.S. citizens, 6) torturing of U.S. citizens and non-citizens, 7) treasonous disclosure of under cover U.S. agents, 8) purposely withholding aid to Katrina victims in Louisiana on the grounds that the governor is a member of the democratic party, 9) blatant disregard for, refusal to comply with, and refusal to enforce Congressional subpoenas, in addition to numerous other grotesque, despicable and un-American acts are not grounds for impeachment, then there never have been grounds to impeach a U.S. President, Vice President or Attorney General, there never will be, and the numerous references to impeachment in the U.S. Constitution are meaningless surplusage.

    Just one question. Is it true that, in America, no one is above the law?

    Not many people believe that today. Most of the folks that I know believe that, of course, the president and his closest confidantes etc are above the law. And also the very wealthy.

    That belief makes people cynical and hopeless. Id like to see that all proved wrong.

    The worst terrorists in our country during the past 8 years were Bush and Cheney. They have destroyed the Constitution.  They have betrayed the trust of the American people and put them into grave danger.  They have destroyed our right to privacy.  They have sent our people into battles that didn't need to be fought, to die and suffer unrepairable physical and mental agony. They have destroyed our economy.

    If these things were done by two foreigners livng in the  USA, they'd be in prison for the rest of their lives.  Bush and Cheny deserve nothing less.
